1. Buyer shall be responsible for and pay all other expenses required to close out the transaction
including an equal share of the cost of survey by The Gateway Engineers, Inc., Engineering
fees, and County planning review fees, pro-rated taxes, recording fees, title insurance, and
attorney’s fees to Paul S. Messick, Jr. Closing shall be within 10 days of subdivision plat
approval by Chatham County in the office of Gunn & Messick, PLLC, Pittsboro, NC.
2. The Property is being sold in separate lots. If purchased by separate bidders, the Property will
be subdivided at the Buyer’s sole cost and expense in substantial conformity with the sale maps
included in the auction and will contract with The Gateway Engineers, Inc. to perform the
survey and coordinate the Chatham County planning review and plat approval process. Buyer
may be required to advance the estimated costs of surveying and review prior to
commencement of services. *Each bid lot shares equally any costs involved with design
and surveying expenses to close transaction estimated to be $58,000 for all five (5) lots;
provided, however, that if all Lots sell to one Buyer, then there will be only a $15,000
cost added and paid to The Gateway Engineers, Inc. by the Buyer at Closing for initial
surveying, planning, etc. and costs. The possible private road design and construction
and permitting fees is estimated to cost $250,000 based on recent engineering
assessment.
3. Seller shall provide the Buyer a general warranty deed to the property, free and clear of all
liens and encumbrances, excepting easements, zoning, encroachments, rights-of-way, and
restrictions of record or as announced at the auction or in auction catalog, including a
Declaration of Easement and Road Maintenance Agreement requiring all lot owners to share
the cost of design and construction of any private road to be constructed on the premises and to
share equally in the cost of future maintenance thereof. The Buyer shall have the right to have
a title examination made at the expense of the Buyer. It is understood that the transaction is to
be closed on or before 45 days from the date of the auction. Time is of the essence. If any
flaw is found by the Buyer’s title examination, then the closing shall be extended and the Seller
cannot provide insurable title, the earnest money deposit shall be returned to the Buyer with no
further liability of the Seller.
